Bankruptcy of the business environment cleansing and displacement for taxpayers
The burden of reference Super cleaning hazardous waste sites and other increasingly on taxpayers, given that business management of hazardous substances are no longer taxed in the legal framework of the superpower and residues cleaning sites need to develop according to a new report from Congressional investigators.
While more than 231000 companies, the USA bankrupt in the years 1998 to 2003, the magnitude of their commitments is not known, since neither the federal government nor other sources collect this information, perhaps says the report, prepared by the Government Accountability Office (GAO).
Information on companies in bankruptcy with debts of the Federal Office of the environment is limited to data on cases of bankruptcy, the department of justice before the courts on behalf of the U.S. Environmental Protection Agency (EPA). The Department of Justice has launched these 136 cases from 1998 to 2003.
The GAO prepared its report in response to a question by Senators Jim Jeffords, a Vermont independent, services, as they Ranking Minority Member of the Senate Environment and Public Works and Democrats Patrick Leahy of Vermont, Ranking Minority acts as a member of the Senate Justice Committee, Barbara Boxer of California, Maria Cantwell and Washington.
In the interests of enterprises are responsible for their environmental performance cleanup obligations of the EPA to considerable challenges, the GAO.
The problems often result from different objectives of environmental legislation, that the environment is responsible for cleaning costs and other laws that in some cases companies to limit or avoid liability for these debts.
Companies can legally organize or restructuring in a way that may be the limit of its future expenditure clearance by the separation of their property to their debts with their subsidiaries.
While many of these actions are legal, transfer of assets on the limitation of liability may be against federal law, in some cases. Even so, these cases are difficult to identify the EPA and the Department of Criminal Justice to success, the GAO.
The purpose of bankruptcy law, a new start for the debtor is an additional challenge for EPAs ability to maintain parties for their cleanup obligations. And the period of business files bankruptcy, it may soon, if ever, assets left to distribute.
In addition, the EPO lack timely, complete and reliable information on businesses of thousands of requests for bankruptcy proceedings each year.
Nevertheless, EPA has helped ensure that the bankrupt financially beleaguered and other companies to fulfil their obligations to clearance by the increased use of the authorities, the GAO reports.
For example, EPA has not implemented the year 1980, a mandate under the Fund Act to require businesses, management of hazardous substances to demonstrate their ability to pay of potential ecological cleaning.
“EPO has cited competing priorities and lack of financial resources for reasons of non-implementation of this mandate, but its inaction has suspended the Superfund program to the USA and taxpayers with enormous costs of cleaning gold, lead and other mining sites and other industrial activities, such as metal plating as businesses, “the GAO reports.
