Jericho arrested in assault on near courthouse

Ralph Burlington police Wednesday arrested on suspicion of attempted murder Merrill arising from an assault Sunday near the downtown courthouse.

Police had been seeking Merrill, 23, of Jericho since the incident, which occurred about 6:15 pm On Sunday Cherry Street outside Vermont District Court in Burlington.

Merrill a man and police declined to identify “had a brief heated exchange, the point at which the suspect began to strike the victim in the head with a flashlight,” according to a news release prepared by Burlington Police Lt. Col. Kathleen stub Bing.

Two passers-interrupted by the attack, and Merrill jumped bell-foot into the passenger side of a silver or beige car with a roof rack and was driven away, police said.

Authorities are continuing to search for the driver, a man they described as possibly wearing glasses and having blond hair.

The assault victim was taken to the hospital, treated for his injuries and released, police said.

Police asked that anyone with information about the incident call the department at 658-2704, ext. 242, Champlain Valley or Crime Stoppers at 864-6666.

Merrill remained in police custody Wednesday afternoon and is scheduled to be arraigned today in the District Court in Burlington, Vermont. An attorney for Merrill could not be reached for comment.

Chittenden County State Attorney’s T.J. Donovan said at 4:15 p.m. His office had yet to receive paperwork from police and it would assess before deciding which to file charges. Prosecutors level could feel aggravated assault charge if they attempted murder is inappropriate given the facts, Donovan said.

“The decision is charging our discretion,” he said.
